Policy on Freedom to Read and the Privacy of Data (Patriot Act)

It is the policy of Murphy Library to preserve completely the freedom to read and to protect all patrons from the invasion of privacy or possible harassment.  Therefore, the library will not reveal the identity of any person who has borrowed a book nor will the library provide information about the reading habits of a patron unless legally required.  For the Library's Privacy Policy, see http://www.uwlax.edu/murphylibrary/departments/confidentiality.html

Confidentiality extends to information sought or received, and materials consulted, borrowed or acquired and includes computer use records, reference interviews, interlibrary loan records and all other personally identifiable uses of library materials, facilities or services.

Circulation records and other information regarding patron use will not be released to any individual, including federal law enforcement officers unless a court order/subpoena or search warrant has been produced.  This policy conforms to Wisconsin State Statute 43.30 as well as to the privacy policy guidelines of the ALA Office of Intellectual Freedom.

Additionally, some student staff have access to the personal files on library staff computers and the file server.  This information is also confidential.

When approached for such information, student staff will adhere to the following procedures:

  • If any person requests personal information about a patron, refer them to a supervisor.  A response of "I cannot provide you with that information.  I will get my supervisor" is sufficient.

  • If a law enforcement official presents a subpoena, contact a supervisor.

  • If you are presented with a search warrant (which requires an immediate response), contact your supervisor or the Library Director immediately.

  • If the visit happens in the evening or on the weekend, explain to the person/s that any information released must come from the Administrative Office and to please call or come back during normal working hours.  If the person insists or is disruptive, call your supervisor or the Library Director at home.

  • Because a gag order may be in effect, do not discuss this visit with anyone but your supervisor and the Library Director.
